1) agrees that he/she is an authorized manager for . agrees to haul this shipment with a truck that has permanent MC# markings on the tractor and is subject to the terms of both the previously signed broker/carrier agreement and also the rate and tracking agreement. Truck will run directly under MC # authority and insurance. Double brokering to a truck that does not have the appropriate markings will void this contract.

2) All accessorial charges are included in the rate above. Additional charges need to be pre-approved and a new rate confirmation would be sent prior to any additional services including, but not limited to...detention, layover, ligate, re-delivery, lumper, driver handling, extra drops, truck ordered not used etc.

3) Driver needs to be actively tracking using the Freight Book App and/or provide an ELD link demonstrating the truck is moving towards the shipper to be eligible for a truck ordered not used. If driver does not have the iOS or Android Freight Book App activated the truck can be canceled with no truck ordered not used. If tracking is disabled any time during transit and not re-activated after a 15 minute written warning is given, both parties agree to a reduction of the rate by $100 for each warning that is not corrected.

4) Freight Book, Inc's payment terms are NET 30 after receipt of invoice and exception free proof of delivery. Failure to provide POD and invoice within 14 days of delivery could result in a $100 deduction from this rate. ACH quick pay is available at Freight Book's discretion with an exception free POD and documented tracking throughout. A voided company check is required for ACH payment.

5) Driver is responsible for choosing the safest route, verifying that the load will ride safely and legally and that product is secured in a manner that is safe for transit. Carrier will use a truck and driver(s) that have adequate hours available to make the defined delivery terms legally and safely. Freight Book will not tolerate breaking any DOT or FMCSA regulations. SAFETY IS THE FIRST PRIORITY OVER ALL ELSE!!!

6) certifies that it has active primary cargo insurance of at least $100,000. Also, the carrier certifies that it has both active auto and general liability policy each having no less than $1,000,000 limits and carrier must also have an active worker's compensation policy of at least $500,000 that covers the driver performing shipment in the state in which the work is being performed or containing an all-states endorsement.

7) When hauling food or food ingredients for Freight Book, Inc every carrier is required to follow the guidelines laid out by the FDA's Sanitary Food Transportation Act of 2005 available at https://www.fda.gov/regulatory-information/search-fda-guidance-documents/guidance-industry-sanitary-transportation-food . Not following these guidelines can result in a cargo claim for the total value of the food ingredients on the trailer.
